1. Acceptance of Terms

By accessing or using the Service, creating an account, or clicking to accept these Terms, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree, you must not use the Service.

If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms, and “you” refers to that organization. You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service.

We may update these Terms from time to time. When we make material changes we will update the “Last updated” date above and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

2. Description of Services

RemoveBG API is an artificial-intelligence-powered service that removes backgrounds from images you submit and returns a processed image (typically a transparent PNG). We offer multiple quality tiers — including a fast standard tier and a high-quality (“HQ”) tier — and provide access through a web interface and a REST API authenticated with an API key.

We may add, modify, or discontinue features, tiers, or models at any time to improve the Service or for operational reasons. We will make reasonable efforts to avoid materially degrading paid functionality without notice.

3. User Accounts

Some features are available without an account (for example, a limited number of free image removals each day). To access the API, monthly images, and other paid features, you must create an account, which you may do by signing in with a supported identity provider such as Google.

• You are responsible for maintaining the confidentiality of your account credentials and API keys.
• You are responsible for all activity that occurs under your account or API keys, whether or not authorized by you.
• You must provide accurate information and keep it up to date.
• You must notify us promptly of any unauthorized use of your account or any other security breach.

Anyone in possession of your API key can consume your images. Treat your API key as a secret and rotate it if you believe it has been exposed.

4. Subscription Plans

We offer a free tier and one or more paid subscription plans (for example, Developer and Creator). Each plan specifies a monthly price, a monthly image allotment, and the features and limits that apply. The current plans, prices, and inclusions are shown on our pricing page, which forms part of these Terms.

Paid plans renew automatically each month until cancelled. You may upgrade, downgrade, or cancel your subscription at any time through the billing portal. Changes take effect as described at the time you make them (for example, upgrades may take effect immediately and downgrades at the end of the current billing period).

5. Image-Based Usage

Usage of the Service is metered in images. One image corresponds to one standard-quality background removal; HQ-quality processing consumes two (2) images per operation. The current rates are always shown in the product.

• Paid plans include a monthly image allotment that refreshes on your billing date.
• Unused images roll over without limit and never expire while your subscription remains active.
• If you cancel, any rolled-over image balance is forfeited at the end of your paid period.
• On paid plans, usage beyond your available balance is billed as metered overage at your plan's per-image rate — processing is never interrupted.
• Free and anonymous usage is subject to daily limits rather than an image balance.
• Image balances have no cash value, are not transferable, and are not redeemable for money except where required by law.

An image is normally consumed when an operation is successfully accepted for processing. If an HQ job fails on our side, the images reserved for that job are returned to your balance automatically.

6. Billing and Payments

Paid subscriptions are billed through our third-party payment processor, Stripe. By subscribing, you authorize us and Stripe to charge your chosen payment method for the recurring subscription fee and any applicable taxes until you cancel.

• Prices are stated exclusive of taxes unless otherwise indicated; you are responsible for any applicable taxes, duties, or levies.
• We do not store your full card details. Payment information is handled directly by Stripe under its own terms and security standards.
• If a payment fails, we may retry, suspend paid features, or downgrade your account until payment succeeds.
• You are responsible for keeping your billing information current.

7. Refund Policy

Except where required by applicable law, subscription fees are generally non-refundable, and cancelling a subscription stops future renewals rather than refunding the current period. You retain access to paid features until the end of the period you have already paid for.

If you were charged in error, experienced a billing fault, or believe you are entitled to a refund under a consumer-protection law that applies to you, contact us and we will review your request in good faith. Images consumed by successful operations are not refundable, but images reserved for operations that fail on our side are automatically restored.

8. Acceptable Use Policy

You agree not to use the Service to, and not to permit anyone else to:

• Upload, process, or distribute content that is illegal, infringing, defamatory, or that violates the rights of others.
• Process images of other people without any consent required by law, or in a way that violates their privacy or publicity rights.
• Create or distribute child sexual abuse material, non-consensual intimate imagery, or other prohibited content.
• Infringe intellectual-property rights, including uploading images you do not have the rights to use.
• Attempt to reverse engineer, scrape, overload, disrupt, or circumvent the security, rate limits, or access controls of the Service.
• Resell, sublicense, or provide the Service to third parties except as expressly permitted by your plan.
• Use the Service to build a competing background-removal model or dataset.
• Use automated means to create multiple accounts to evade limits or free-tier quotas.

We may investigate suspected violations and cooperate with law enforcement where required. Violations may result in suspension or termination without refund.

9. Intellectual Property

Your content. You retain all ownership of the images you upload and of the processed results we return to you. You grant us only the limited, temporary license needed to process your images and deliver the results to you, as described in our Privacy Policy. We do not claim ownership of your content and do not use it to train AI models.

Our property. The Service, including its software, models, website, design, logos, and documentation, is owned by VVAi Studio or its licensors and is protected by intellectual-property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. All rights not expressly granted are reserved.

10. AI-Generated Results Disclaimer

The Service uses machine-learning models to remove image backgrounds. Results are generated automatically and their quality depends heavily on the input image (lighting, contrast, subject complexity, fine details such as hair, and more). We do not warrant that results will be accurate, error-free, complete, or fit for any particular purpose.

You are responsible for reviewing outputs before relying on or publishing them. AI outputs may contain artifacts or imperfections. The Service is a tool to assist you, not a substitute for your own judgment.

11. User Responsibilities

• Ensure you have all rights and permissions necessary to upload and process each image.
• Comply with all applicable laws, including data-protection, privacy, and export-control laws.
• Keep your credentials and API keys secure and use the Service only for lawful purposes.
• Do not rely on the Service as your sole copy of any image — retain your own originals.
• Monitor your own usage and image consumption.

12. Service Availability

We strive to keep the Service available and performant, but we provide it on an “as is” and “as available” basis. We do not guarantee uninterrupted or error-free operation. The Service may be unavailable for maintenance, updates, or reasons beyond our control, and processing times may vary — particularly for the HQ tier, which is processed asynchronously.

Unless a separate service-level agreement is expressly agreed in writing, we make no uptime commitment.

13. Limitation of Liability

To the maximum extent permitted by applicable law, VVAi Studio and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities, arising out of or related to your use of (or inability to use) the Service, even if we have been advised of the possibility of such damages.

To the maximum extent permitted by law, our total aggregate liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid us for the Service in the three (3) months immediately preceding the event giving rise to the claim, or (b) fifty US dollars (US$50).

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including certain rights you may have as a consumer.

14. Indemnification

You agree to indemnify, defend, and hold harmless VVAi Studio and its officers, employees, and suppliers from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) the images or other content you submit; (c) your violation of these Terms or any applicable law; or (d) your infringement of any third-party right.

15. Account Suspension and Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access, with or without notice, if you breach these Terms, if required by law, to protect the Service or other users, or in response to non-payment.

On termination, your right to use the Service ceases, unused image balances and paid features may be forfeited (except where prohibited by law), and provisions that by their nature should survive — including intellectual property, disclaimers, limitation of liability, and indemnification — will survive. For clarity, we do not retain your processed images after their short automatic deletion window regardless of account status; see our Privacy Policy.

16. Governing Law

These Terms are governed by the laws applicable in the jurisdiction in which VVAi Studio is established, without regard to conflict-of-laws principles, and, to the extent permitted by law, you agree to the exclusive jurisdiction of the courts of that jurisdiction. This does not deprive you of any mandatory consumer protections available to you where you live.
